Redefiniendo las Comisiones Inmobiliarias: Empoderando a los Vendedores de Casas en Miami


La Asociación Nacional de Realtors (National Association of Realtors) ha alcanzado recientemente un acuerdo histórico que desafía la estructura tradicional de comisiones en las transacciones inmobiliarias. Las nuevas reglas de comisiones del acuerdo recibieron una aprobación preliminar de un juez federal en abril, con la aprobación final del tribunal anticipada para noviembre.

El acuerdo busca mejorar la transparencia y ofrecer oportunidades de ahorro de costos para los vendedores, permitiéndoles pagar solo la comisión de su propio agente, en lugar de la comisión tanto de su agente como del agente del comprador. Opciones de Acuerdo de Listado del Vendedor
1) Opción A, Representación Exclusiva del Vendedor: La comisión es del 3% para su representación exclusiva del vendedor. Esto implica que si un comprador no tiene representación de un agente del comprador, el agente del vendedor no podrá asistir al comprador en la transacción.

2) Opción B, Representación del Vendedor/Comprador/Agente del Comprador: La comisión es del 3.75%, lo que permite a los vendedores extender activamente la presentación a compradores sin agentes o aquellos con agentes inmobiliarios que los representen, todo por una comisión del 3.75%.

Impacto en los Compradores y Agentes

Este cambio en las estructuras de comisiones impactará tanto a los compradores como a los agentes del comprador, ya que ahora se les requerirá firmar un Acuerdo de Representación del Comprador para recibir servicios inmobiliarios por una tarifa. Aunque esto puede ser un enfoque novedoso para los agentes inmobiliarios en Florida, no es un territorio desconocido para los agentes en otros estados.

Los compradores pronto se enfrentarán a la tarea de seleccionar un agente del comprador y considerar sus tarifas de servicio asociadas, lo que plantea una disyuntiva: ¿Cómo deberían manejar las tarifas de comisión de su agente? ¿Deberían recurrir a sus ahorros, lo que podría afectar su pago inicial o costos de cierre? ¿Deberían intentar negociar con el vendedor para cubrir una parte de la comisión, arriesgándose a perder la casa ante otro comprador? ¿Podrán obtener un préstamo personal que aumentaría la responsabilidad financiera del comprador?

La Asociación Nacional de Realtors está buscando activamente una confirmación clara sobre este asunto.

Además, espero que las personas que navegan casualmente por las propiedades sin una intención genuina de comprar, a menudo referidas como "mirones", disminuyan y muestren menos interés en contratar un agente del comprador solo para ver propiedades. Es importante recordar que los agentes inmobiliarios incurren en varios gastos al operar sus propios negocios, y proporcionar servicios sin obtener ingresos es una preocupación para todos nosotros.

Esta nueva realidad permitirá a los agentes asignar su tiempo de manera más eficiente, centrándose en compradores calificados que estén dispuestos a colaborar y contratar sus servicios por una tarifa.
